Terms of Use

Welcome to Whale Me Up! These Terms of Use ("Terms") govern your access to and use of our website, application, and services (collectively, the "Service"), which are owned and operated by Carlos Bustamante Bozzi, a sole proprietor ("we," "us," or "our").

Please read these Terms carefully. By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

1. Description of the Service

Whale Me Up! is a real-time cryptocurrency ratio analysis platform. The Service provides users with tools to create and monitor custom widgets, analyze cryptocurrency market data, and set up alerts based on user-defined thresholds. The Service is intended for informational purposes only.

2. Acceptance of Terms

By creating an account or by using any part of the Service (including browsing as an anonymous user), you confirm that you have read, understood, and agree to be bound by these Terms. You also affirm that you are at least thirteen (13) years of age. If you do not agree, you are not permitted to use the Service.

3. User Accounts

You can use our Service in two ways:

  • Anonymous Users: You can use the core features of the Service without creating an account. Your configurations will be tied to a temporary ID and stored for up to 72 hours after your last session.
  • Registered Users: To save your configurations permanently and access all features, you must create an account using an email and password or by authenticating through a third-party service like Google (OAuth).

As a Registered User, you are responsible for:

  • Providing accurate and complete registration information.
  • Maintaining the confidentiality and security of your account password.
  • All activities that occur under your account. You must notify us immediately at support@whalemeup.com of any unauthorized use of your account.

4. User Conduct and Prohibited Activities

You agree not to use the Service for any purpose that is illegal or prohibited by these Terms. You are responsible for all of your activity in connection with the Service. Prohibited activities include, but are not limited to:

  • Attempting to reverse-engineer, decompile, disassemble, or otherwise attempt to discover the source code of the application.
  • Using any robot, spider, scraper, or other automated means to access the Service for any purpose without our express written permission.
  • Imposing an unreasonable or disproportionately large load on our infrastructure.
  • Distributing viruses, spam, or any other malicious code.
  • Using the Service to engage in any fraudulent, abusive, or illegal activity.
  • Infringing upon or violating our intellectual property rights or the intellectual property rights of others.

5. Intellectual Property Rights

The Service and its original content, including the "Whale Me Up!" name, logo, features, functionality, and application code, are and will remain the exclusive property of Carlos Bustamante Bozzi. The Service is protected by copyright, trademark, and other laws. Our trademarks may not be used in connection with any product or service without our prior written consent.

6. Disclaimers and No Financial Advice

This section is crucial. Please read it carefully.

  • "AS-IS" Basis: The Service is provided on an "AS-IS" and "AS-AVAILABLE" basis. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.
  • No Warranty on Data: The cryptocurrency market data provided through the Service is aggregated from third-party sources. We do not guarantee the accuracy, completeness, timeliness, or reliability of any data or information displayed.
  • NOT FINANCIAL ADVICE: Whale Me Up! is NOT a financial advisory service, a broker, or a fiduciary. The content, data, and alerts provided by the Service are for informational and educational purposes only. Nothing on the Service should be construed as financial, investment, legal, tax, or any other form of advice.
  • Your Responsibility: You are solely responsible for your own financial and investment decisions. You should conduct your own research and consult with a qualified financial professional before making any investment decisions. By using the Service, you agree that you are using the information at your own risk and that we are not liable for any losses or damages that may result from your reliance on this information.

7. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Carlos Bustamante Bozzi, his affiliates, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

8. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

If you wish to terminate your account, you may do so by using the deletion feature within the application. Upon termination, your right to use the Service will immediately cease. Please refer to our Privacy Policy for details on data handling after account termination.

9. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the Slovak Republic, without regard to its conflict of law provisions.

You agree to submit to the personal and exclusive jurisdiction of the courts located within Slovakia to resolve any dispute or claim arising from these Terms or the Service.

10. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
